• We accept Visa and MasterCard. To protect our customers from credit card fraud, the billing address on your order form must match the billing address where your monthly credit card statement is mailed.

This agreement constitutes the entire agreement between you and XtremeAir regarding the purchase of goods or services from this site. It may only be modified or terminated in writing, signed by XtremeAir. Valid electronic records (including signatures) will be accepted under this agreement.

In the event of a conflict between the terms stated on your purchase order and those in this agreement or on our invoice, this Sale Agreement and our invoice shall control.

By purchasing from XtremeAir, you consent to the jurisdiction of federal or state courts located in Orange County, California, for any legal proceedings related to this agreement.

XtremeAir expressly disclaims all warranties, whether expressed or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.

This disclaimer does not affect the terms of any manufacturer’s warranty, if applicable.

Internet Disclaimer

Internet connectivity requires service from an Internet access provider. Please contact your local provider for applicable rates, terms, and conditions.

Pricing and Information Disclaimer

XtremeAir reserves the right to adjust prices due to changing market conditions, product discontinuation, manufacturer price changes, errors in advertisements, or other circumstances.

Arbitration

Any claim, dispute, or controversy arising from this Sale Agreement—including contract, tort, statutory, common law, or other claims—shall be resolved exclusively by binding arbitration through the National Arbitration Forum (NAF) under its Code of Procedure.

If an in-person hearing is required, it will be held in Orange County, California.

Each party will bear its own costs for legal representation, discovery, or research required for arbitration.

Orders, Payment Terms, Interest, and Taxes

​

Orders are not binding until accepted by XtremeAir. Payment terms are at XtremeAir’s sole discretion.

• Invoices are due within the period specified on the invoice, starting from the invoice date.

• Partial shipments may be invoiced separately.

• Late payments will accrue interest at the highest rate allowed by law.
